Virginia court dismisses Massey-Blankenship suit against the United Mine Workers of America and International President Cecil Ro

FAIRFAX, VA -- A Fairfax County, Va., circuit court today again dismissed a defamation suit filed by Massey Energy Co. and its CEO, Don Blankenship, against the United Mine Workers of America and its International President, Cecil E. Roberts.

"We said all along that we would be vindicated in this frivolous suit, and that justice would prevail," President Roberts said. "It is clear by today's action that the attempt by 'The Donald' and his army of corporate lawyers to silence our Union and the citizens of West Virginia has failed."

The court also dismissed similar claims against the Charleston Gazette.

Last August, the same court dismissed an earlier defamation suit filed by Massey Energy and Don Blankenship when the plaintiffs failed to specify exactly what union statements were supposedly defamatory. Massey and Blankenship filed an amended complaint trying to correct the defect. The court dismissed the lawsuit again, finding that the public statements by the Union and President Roberts were not defamatory, period.
